VISTA, San Diego County — October 23, 2026. Vista homeowners seeking to reduce development fees for a backyard dwelling should distinguish automatic state-law exemptions from the city’s additional fee waiver program. The official ADU Fee Waiver Program explains that some development impact fees can be waived if the unit is occupied by a qualifying lower-income household or a family member or caregiver providing regular care, and if the property owner signs a recorded covenant.
How long does the obligation last?
Vista’s published requirements apply for the first ten years after the ADU receives a certificate of occupancy. The owner must execute and record a Covenant Agreement Restricting Occupancy and Rents. For the income-qualified option, the household’s gross income generally must not exceed 80% of the San Diego County median, adjusted for household size, under the program’s current standards.
Is every ADU application eligible?
No. Vista separately notes that some development impact fees for smaller ADUs are automatically restricted or waived under statewide rules. The municipal incentive has its own conditions and reporting obligations. An ADU can be permissible to build while its owner is ineligible for the discretionary local fee waiver. Confirm the actual project’s size, zoning, fees and financing requirements before counting on savings.
What documents are required?
According to the city’s program instructions, the owner must submit project plans and proof of ownership, sign and notarize the covenant and pay the applicable recording charges. The city calls for an initial Occupancy Certification Form and annual recertification through the ten-year covenant period. Qualifying lower-income tenant households must provide approved income-verification documents, while the caregiver pathway requires separate care verification.
What happens if the ADU is rented?
Vista’s instructions say the owner must provide the required lease addendum within 30 days after signing a lease covered by the covenant. A fee waiver can create continuing obligations after construction, so owners should read the full recorded agreement with qualified counsel if necessary. Do not assume they may switch the unit to unrestricted rent or short-term vacation rental immediately after final inspection.
Who can explain the current program?
